Terms of Service

The terms and conditions that govern use of our website and services.

1. Agreement to Terms

By accessing our website at language.services or by engaging us for any service, you agree to these Terms of Service. If you do not agree, please do not use the website or our services. These Terms apply to all visitors, prospective clients, and active clients.

2. Services We Provide

ELP Language Translation Services LLC ("ELP") provides language services including: informal language assessments, language learning instruction, live spoken interpretation, written translation and editing (including post-editing of human or machine translations), interpretation equipment rental, homeschool support services, and custom language projects. Specific scope, deliverables, timelines, and fees are described in a written quote or agreement for each engagement.

3. Quotes, Estimates, and Payment

  • Quotes are provided in writing and are typically valid for 30 days from issue.
  • A deposit may be required to begin work, particularly for projects exceeding a small minimum or for new clients. The deposit amount will be specified in the quote.
  • Final payment is due on completion of services unless otherwise agreed in writing.
  • For ongoing services (such as homeschool support or recurring lessons), invoices are issued on the schedule agreed at the start of the engagement.
  • Late payment may result in suspension of services and the addition of reasonable late fees as permitted by Texas law.

4. Scheduling and Cancellations

  • Appointments can be booked through our website scheduling pages or by contacting us directly.
  • We ask for at least 24 hours notice to cancel or reschedule any appointment so that we can offer the slot to another client.
  • For interpretation engagements and equipment rentals booked in advance, cancellation terms specified in the project agreement apply. Last-minute cancellations may be subject to a cancellation fee to cover prepared resources and reserved time.
  • No-shows for scheduled appointments may be subject to a fee equal to the full session cost.

5. Client Responsibilities

To help us serve you well, you agree to:

  • Provide accurate information about your project, event, student, or learning needs.
  • Share materials, documents, and access we need to do the work, in time for us to deliver on schedule.
  • Have the legal right to share any document or content you give us for translation, editing, or interpretation.
  • Treat our staff and partner network professionally and respectfully.

6. Translation and Interpretation Accuracy

We take great care to deliver accurate, contextually appropriate language services. However, language is inherently nuanced, and certain terms, idioms, or specialized content may have more than one valid interpretation. We will work in good faith to clarify your audience and purpose, and we welcome questions or feedback on any deliverable. Translation and interpretation services are professional opinions, not certified legal opinions, unless we have specifically agreed in writing to provide a certified translation.

7. Equipment Rental

Interpretation equipment is rented based on the agreement specific to your event. The client is responsible for equipment from the time of delivery or pickup until return, including loss, theft, or damage beyond normal use. A security deposit may be required. Damages beyond normal use will be billed at replacement or repair cost.

8. Homeschool and Minor Student Services

Services involving minors require enrollment by a parent or legal guardian, who is responsible for ensuring the minor's safety, consent, and supervision. We follow professional standards of care during instruction, but the parent or guardian remains the educational and legal decision-maker for the student. Use of PDSES, TEFA, or other state-funded programs is subject to the rules of those programs as administered by the Texas Education Agency or other applicable authority.

9. Confidentiality

We treat client information, documents, and conversations as confidential. We will not share your project content with anyone outside our trusted partner network without your consent, except as required by law. Our subcontractors are bound by confidentiality obligations as well.

10. Intellectual Property

Upon full payment, the client receives ownership of the final deliverables we produce for them (for example, a completed translation document). ELP retains the right to reference completed projects in general terms for portfolio and marketing purposes, without disclosing confidential content. The ELP name, logo, website content, and business materials are the property of ELP Language Translation Services LLC.

11. Disclaimers and Limitation of Liability

ELP provides services with professional care, but we make no warranties beyond those expressly stated in a written engagement agreement. To the maximum extent permitted by Texas law, our liability for any claim arising out of or related to our services is limited to the total fees you have paid us for the specific engagement that gave rise to the claim. We are not liable for indirect, incidental, special, or consequential damages.

12. Indemnification

You agree to defend, indemnify, and hold ELP and its officers, employees, and partners harmless from any claims, losses, or damages arising from your misuse of our services, your violation of these Terms, or your violation of any law or third-party rights.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or our services will be resolved exclusively in the state or federal courts located in Texas, and you consent to that jurisdiction. Before pursuing formal legal action, both parties agree to attempt good-faith resolution through direct communication.

14. Website Use

You agree not to misuse our website, including but not limited to: attempting unauthorized access, introducing malware, scraping content for unauthorized purposes, or interfering with other users. We reserve the right to suspend access for misuse.

15. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date will reflect the most recent revision. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
